Handing over Milosevic on the fantasy charge of genocide in Kosovo--no doubt with a quiet plea that other matters should be wrapped up soon please--would, of course, briefly elevate the status of the politicians who obtained it, but it would not alter the status of Serbia. That can only be done by hard work and economic achievement. ‘Compliance’ would buy next to nothing and lose much. It would signify nothing but national weakness and cynicism about the promises Kostunica made before he was elected. What would be seriously impressive would be the trial of Milosevic himself in Belgrade and, beyond that, a Serbian commission of inquiry into the ugliest events of 1991-1992.

It ought to be obvious that the trial of Milosevic would be far more revealing in a Serbian courtroom than if it were sterilized, and de-contextualized, at The Hague where the charges are both pared down by secret service filters and hyped up by legal ambition. The ICTY charge sheet is the problem. In Serbia, that is in a Serbian court, the trial would be genuinely unpredictable, more disturbing and more important.

Serbia needs this trial. It is hers: her right and her duty. It would be a catastrophe for international lawyers to deprive the people of this therapeutic moment. The trial should be on TV every night. A more inquisitive legal process than anything possible at The Hague would attract the admiration of the world. It would explode the case for the ICTY and silence all but its salaried staff.

In reality Serbia’s status in Europe will not be measured through the prism of compliance but only through its own ability to embark on sustained economic, political and social recovery. The Hague is the wrong issue altogether: it exists only in so far as it enjoys the support of political decision-makers in the western world, primarily the United States. The new administration in Washington is rightly uneasy about the International Criminal Court. It may yet see merit in the argument that a public trial of Milosevic in the Serbian capital, and before a Serbian court, is the only way for both Serbia and the world to learn the truth about the tragic decade behind us. It is also the only way to do justice, and to see it done.
