The family of Kevin Ward Jr, the driver killed in a sprint car accident involving Tony Stewart last year, has filed a wrongful death lawsuit against the three-time Cup champion.

The suit, which comes two days before the August 9 anniversary of the crash at Canandaigua Motorsports Park, accuses Stewart of gross negligence. Ward was killed when he walked onto the track to remonstrate with Stewart after the pair made contact, and the lawsuit claims that the 20-year-old's death was the consequence of Stewart blipping the throttle and putting his car into a skid.

Ward's family has requested a jury trial and is seeking unspecified monetary damages. Earlier, a grand jury elected not to indict Stewart.

"Kevin Ward would be alive today if not for the reckless and dangerous actions of Tony Stewart, who eventually will have to answer for what he did," the family's lawyer, Mark Lanier, told the Associated Press.

Stewart is preparing to race at Watkins Glen this weekend.

Tony Stewart went into the stands to confront an apparent heckler Friday night at the Chili Bowl midget races in Tulsa, Okla., multiple news sites reported after amateur video of the incident emerged.

Fans were caught on video chanting "Tony!" as Stewart gets in the face of an apparent heckler in the grandstands, puts his hands on him and engages him verbally before another man, apparently a security member, pushes the man into his seat, while Stewart leans in and continues to talk.

Stewart is not competing in the Chili Bowl but is participating in preparations of the track (pictured).

Stewart declines comment on Chili Bowl confrontation with off-duty sheriff

An off-duty county sheriff reported to be highly inebriated was confronted by Tony Stewart on Friday night after screaming "murderer" at the three-time NASCAR champion while he helped prepare the track for the 30th annual Chili Bowl.

According to eyewitnesses, Kyle Hess kept taunting Stewart from his seat in the grandstands as the 44-year-old racing star went into the seats to confront his heckler. He placed his hands on Hess' shoulders and asked what his problem was before Hess shoved Stewart and then a security guard pushed Hess back down into his seat.

Hess was escorted off the Expo Center premises but Stewart took no action.

Dennis Larson, a Tulsa deputy police chief who also serves as a liaison officer at the Expo Center, told the Tulsa World that Hess was "under the influence of alcohol."

Stewart declined to comment on Saturday.

Two photographers in the area told RACER.com they heard Hess yelling "murderer," referring to the 2014 sprint-car accident in New York that took the life of Kevin Ward Jr. when he charged Stewart's car during a caution period. The grand jury refused to indict Stewart on any charges but he's still facing a wrongful death lawsuit from Ward's family.

COLE SMITH: Tony Stewart's between a rock and a hard place
Wednesday, 20 January 2016
Steven Cole Smith

Thursday is likely to be a bad day for Tony Stewart. Should he decide to participate – and for the benefit of his sponsors, he should – there is a 45-minute media availability for Stewart-Haas Racing at the annual Charlotte Motor Speedway NASCAR Media Tour.

He is likely to be questioned about last week's incident at the Chili Bowl in Tulsa, Oklahoma, in which Stewart climbed into the grandstands to confront an abusive fan.

It happened on Friday in the typically-rowdy seats just past turn two. I was in the infield with Stewart during a qualifying race for Saturday's main event. One minute Stewart was there, the next he was in the grandstands amidst adoring fans chanting "Tony! Tony!"

Well, one fan was not so adoring. Tulsa Sheriff's Deputy Kyle Hess, off-duty, obviously, had been heckling Stewart, according to one report for the better part of a week. The races had begun on Monday.

According to RACER's Robin Miller, Hess, who the Tulsa police department said had been drinking, may have been shouting that Stewart was a murder, a reference to last year's tragedy when a young sprint car driver, convinced that Stewart had wrecked him on the driver's home track in New York, confronted Stewart on the track and was run over by Stewart's sprint car.

Stewart has not participated in his favorite event since he himself was injured in a sprint car crash two years ago, and now spends the week here as a civilian, grooming the track and helping keep the show going as they pare 335 entries into the 24-car Saturday night spectacle. Many of us believe that when Chili Bowl founders Lanny Edwards and Emmett Hahn, both senior citizens, want to move on, Stewart will take over the race, much as he took over Eldora Speedway after owner Earl Baltes retired.

Deputy Hess had been yelling at Stewart as Stewart worked the track, sometimes on foot and sometimes aboard a tractor. I can attest that Stewart did not seem particularly agitated before he walked – not charged, walked into the stands, which are right up against the racing surface, not removed as with most tracks. As you no doubt saw on the multiple fan videos, Stewart asked Hess what the problem is, and Hess responded, "I never liked you."

There was some extremely minor shoving, most by security guards, and neither man threw a punch. But what if they had? Stewart is still facing a civil suit in the death of Kevin Ward, Jr., the young sprint car driver, for wrongful death, though all criminal charges were dismissed. If Ward's attorneys wanted to establish a pattern of Stewart's volatility, a fight in the grandstands would have contributed to that.

To me, it comes down to this: Would you respect Stewart more if he confronted Hess, or if he didn't?

Since this is a column, I get a say: I respect Stewart a lot more for what he did, than if he had gone on for another day of listening to Hess' taunts and seeing his hand gestures that, it has to be said, did not reflect well on the Tulsa Sheriff's department.

Rico Abreu, who picked up his second straight Chili Bowl win, is a friend of Stewart's, and in fact had been staying with him as Abreu made his own Media Tour appearance on Tuesday.

"I think he's fine," Abreu told RACER. "Some people have opinions and that's fine, but don't criticize someone who is working hard. He worked his ass off all week and he didn't get paid to do that – he did it because that's his passion and something he likes to do.

"I think it's awesome for what he has done for the sport of short track racing and what he does for the Chili Bowl and he just looks to make things better."

Another driver known for speaking his mind, former NASCAR champion Darrell Waltrip, sympathizes with Stewart:

"Man, that's such a sensitive subject. There's so much going on in Tony's world. I think in hindsight, if he had it to do over again he probably shouldn't have done that, and if I had been there with him, I'd have told him, 'No, you don't need to go up there.' If fans don't like you, they boo you, and you just got to let it go. It'd be a lot wiser.

"I love the guy. I love his passion. I love the fact that in a situation like this he'd be willing to take the risk to confront that guy. But when you leave the track and go behind the fence and into the seats, that's not the wisest think to do. Maybe if somebody was hollering enough stuff at me I might do the same thing. Sometimes you just can't help it."

He is reminded that at least once, he couldn't help it. In 1999, he missed qualifying for the race at Michigan.

"I was upset. You know that walkover bridge before you go into the garage? There was a guy up there and he was hollering all sorts of unnecessary things at me, and I bailed off the golf cart and went after him. And that guy hauled butt! I'm probably glad he did because I don't know what I would have done if I had caught him, but I was hot."

Tony Stewart has been hospitalized with a back injury, according to a statement issued by his Stewart-Haas Racing team.

According to the SHR statement, Stewart was hurt in a non-racing accident Sunday afternoon and was transported to a hospital in an undisclosed location. The team added that Stewart is able to move all his extremities.

Stewart-Haas spokesperson Mike Arning added that an update on Stewart's condition "will be provided Thursday afternoon when more information is known."

Stewart, 44, is a three-time champion in NASCAR's top league and is entering his final full season as a driver for SHR in the Sprint Cup Series.
